Meiling Circle (MLC) is a subsidiary of Monsoon Hong Kong Ltd. This Disclaimer applies to all programs, activities, excursions, events, and associate services offered by MLC, or any other company, affiliate, partner associated with Monsoon Hong Kong Ltd., whether inside or outside Hong Kong
By participating in any MLC activity, you agree to be bound by the following terms and conditions.
- Membership Registration Accuracy
In consideration of being permitted to participate in one or more of Meiling Circle’s programs, I hereby represent and warrant that all details I have submitted in the Membership Registration Form are correct and truthful.
I agree to immediately notify MLC in writing or by email of any changes to my personal status, including but not limited to: address, telephone number(s), or acquisition or surrender of any nationality or passport.
- Disclosure of Information
I agree that MLC may disclose information I provide (including photographs, personal details, and contact information) for all relevant purposes in connection with MLC’s activities. I further understand and agree that MLC may disseminate my personal information when:
- Required for enterprise visits, government institutions, universities, or similar organized activities;
- Required by law; or
- MLC has a good faith belief that disclosure is necessary to comply with legal process, protect its rights or property, or act in an emergency to protect the safety of another person.
- Exclusion from Activities
I understand and agree that MLC may, with or without cause, exclude me from participation in any visit to leading enterprises, government bodies, or academic institutions in China or Hong Kong at any time.
- No Public Liability Insurance
I understand that MLC carries no public liability insurance and makes no representations or warranties, either express or implied, as to the accuracy or authenticity of information furnished by other members, associates, or third parties involved with us.
- Information Accuracy Disclaimer
I understand and agree that any information provided to me regarding hotels, venues, events, or excursions has been checked by MLC and, to the best of its knowledge, appears correct. However, MLC cannot and does not guarantee that any such information is 100% accurate and makes no representations whatsoever regarding any individual, place, company, institution, or product.
- Assumption of Risk – Interpersonal Interactions
I understand that I must make every effort to satisfy myself that any person I interact with at an MLC event or excursion is safe, trustworthy, and acceptable to me.
I hereby expressly, voluntarily, and knowingly assume full and complete risk of interacting with any individual(s) with whom I come into contact, directly or indirectly, by virtue of my participation in MLC events or excursions.
- Indemnification (Holding MLC Harmless)
In further consideration of being permitted to participate in one or more of MLC’s programs, I agree to fully and completely indemnify and hold harmless Meiling Circle, Monsoon Hong Kong Ltd., and their principals, owners, officers, directors, heirs, successors, subsidiaries, affiliates, and assigns from any and all damages (including but not limited to costs of defense, attorneys’ fees, and court costs), claims, causes of action, suits, demands, and liabilities of whatever nature — including but not limited to damages for personal injuries and emotional distress — that arise directly or indirectly as a result of:
- Any service(s) provided by MLC; and or associates
- Any action or failure to act on the part of MLC;
- Any claim for improper or negligent dissemination of private, unauthorized, or inaccurate information about me;
- Any claim that MLC placed me in a false light; or
- Any claim that I relied to my detriment on any representation, information, opinion, or advice provided by MLC.
This indemnification applies whether the claim arises during the term of this agreement or at any time thereafter.
- Arbitration Agreement (No Court Lawsuits)
I agree to submit any dispute arising under this agreement — except a dispute alleging criminal violations — to arbitration before a mutually acceptable neutral arbitrator.
If an arbitrator cannot be agreed upon, the party seeking arbitration will refer the matter to a mediator of their own choosing, who shall preside over the dispute. The ruling of this mediator/arbitrator shall be final, binding upon the parties, and enforceable as a final judgment pursuant to the laws of Hong Kong.
In the event of any dispute, the prevailing party shall be entitled to reasonable attorneys’ fees and costs. This agreement to arbitration affects important legal rights. I under-stand that by agreeing to this provision, I will not be able to initiate a lawsuit in court.
- Entire Agreement
This Disclaimer, together with the Privacy Policy & Terms of Service constitutes the entire understanding between me and Meiling Circle. No oral representations by either party shall in any way affect this agreement. I represent that I am not acting in reliance upon any agreements, promises, or representations not expressly set forth herein.
- Acknowledgment of Publicly Posted Terms
THIS DISCLAIMER, THE PRIVACY POLICY, AND THE TERMS OF SERVICE ARE ALL PUBLICLY POSTED ON THE MEILING CIRCLE WEBSITE: www.Meiling.hk OR OTHER RELEVANT WEBSITES.
BY EFFECTING PAYMENT TO MEILING CIRCLE OR HER AUTHORIZED AGENT, I REPRESENT THAT I HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL THE FOREGOING AND PUBLISHED TERMS AND CONDITIONS WITHOUT CONTEST.
We hope your participation in our enterprise visits, networking lunches/dinners, and all other activities will be safe and enjoyable. Please kindly be informed that MLC does not hold any public liability insurance. You acknowledge and accept all risks and liabilities on your own account. Furthermore, we cannot guarantee the full accuracy of third-party information nor the conduct of other participants. You hereby agree to assume full responsibility for your own personal safety and well-being. You acknowledge and agree that any and all ordinary disputes will be settled through arbitration under the laws of Hong Kong.
